About

A Residence Permit for EU Family Member is used to reside in Spain if you are a relative of an EU citizen, or you have formed a civil partnership (Pareja de Hecho) with this resident of the European Union. As such, you can quickly begin working and living in Spain.

Who are considered family members of EU citizens?

A foreign citizen is assumed EU citizen's "immediate family member" if they can prove the following relation.

  • a parent of an EU citizen under the age of 21, who actually looks after this young resident.
  • registered partner or a spouse.
  • descendant under the age of 21 or a descendant of an EU citizen's spouse. 
  • descendant or ancestor of an EU citizen. Or descendant or ancestor of a spouse of an EU citizen, who is or was reliant on this nourishment or care instantly before entering the region, in a state of which the person concerned is a citizen or in which the person concerned has been permitted stay, for the purpose of meeting his basic needs.

Obtaining this permit is one of the ways to begin living lawfully for an extended period in Spain. It saves your time by avoiding a broad list of prerequisites and time-consuming paperwork. 

Eligibility

The following are the requirements for bringing a relative to Spain under this residence permit.

  • Have sufficient financial resources to sustain your family if you are not employed.
  • In Spain, full-coverage health insurance (public or private) is required if you are not working.
  • You must be a self-employed worker in Spain as a European Union citizen.

Documents

The following documents must be presented to receive this visa:

  • EX-19, the completed application form.
  • Documents demonstrating a kinship relationship between a European citizen and a non-European citizen seeking a visa.
  • Non-European citizen's passport.
  • Because the NIE number alone is insufficient, you'll need a DNI (if you're Spanish) or an EU certificate (if you have a green card).
  • A document verifying a healthcare insurance contract.
  • If you're a student, you'll need to fill out an enrollment form at the academic centre.

Process

When to Apply
You should keep in mind the processing time before applying for the residence permit. Plus, also make sure you have all the documents in order before you apply.

The visa may take three months or even more to process.

How to Apply
Following the approval of the application, your relatives have just two months to apply for a visa. To apply, they need to visit in person at the Spanish Consulate or Embassy in their native country. An interview may be requested of them.

Residence Permit EU Family Member is valid for five years after applying, but it can be extended later.

Fees
You must earn a minimum of €25,560 per year, plus €6,390 for an additional family member. Investments, annuities, sabbaticals, and other kinds of income are all possible sources of revenue. You may have to pay fees starting from 70 EUR at the time of application.

Extension

You will need to renew your permission after the first five years of living in Spain. Essentially, the prerequisites are same. You must show that your familial ties are still intact. Also proof that you still have sufficient financial resources.

You can also apply for a permanent stay after the five years of living in Spain.
