About

Partner Visa (Apply Overseas) is a family visa offered to you if you are in a relationship with an Australian citizen. It is further divided into two subclasses.

Subclass 309
This visa allows the spouse or de facto partner of an Australian permanent resident, Australian citizen, or eligible New Zealand citizen to live temporarily in Australia. Getting this visa is the first step toward a Permanent Partner Visa (Subclass 100).

Subclass 100
Subclass 100 visa lets the spouse or de facto partner of an Australian permanent resident, Australian citizen, or an eligible New Zealand citizen live permanently in Australia. It is normally given to people who hold a Temporary Partner Visa (Subclass 309).

ELIGIBILITY

To be eligible, you need to fulfil the following criteria:

  • You must be in a real relationship with your spouse or de facto partner, an Australian permanent resident, Australian citizen, or eligible New Zealand citizen.
  • When applying for this visa, you must be outside of Australia.
  • In the case of Subclass 100, hold a Temporary Partner (Provisional) Visa (Subclass 309).
  • In most cases, continue to have a genuine and ongoing relationship with your partner.

Documents

While applying for this visa, you may need to provide several documents like:

  • Identity documents, including birth certificate and passport.
  • Proof of your relationship with your partner/sponsor. It may include a marriage certificate or viable proof of a de facto relationship.
  • Documents of the dependents, children in most cases.
  • You may have to provide additional documents while applying for Subclass 100, especially if there is a change in your relationship.

The process of application is online. You have to complete your application in ImmiAccount, gather your documents and pay the visa fee.

When to Apply
The visa processing can take several months. So, you should apply at least six months before you want to move to Australia.

Visa Processing Time
The visa may take about six months to process. Depending on your documents and other factors, it may take a year or more.

DURATION & FEES

Duration
You can stay on the Subclass 309 visa until your Permanent Visa (Subclass 100) application is decided, or you withdraw the application. For most applicants, this stay is from 15 to 24 months. But once you avail of Partner Visa (Subclass 100), your status becomes permanent, and you may stay in the country indefinitely.

Fees
The visa may cost AUD 7,850 for the main applicant. This fee covers both the Temporary Visa (Subclass 309) and the Permanent Partner (Migrant) Visa (Subclass 100). Each family member must pay a fee when applying with you unless they hold a Dependent Child Visa (Subclass 445). There is no fee for Subclass 445 Visa holders.

EXTENSION

Partner Visa (Subclass 309) is applicable for 15-24 months, after which you are eligible for a Permanent Visa (Subclass 100). However, you cannot travel in and outside Australia for more than five years on this visa.
