Partner Visa Temporary (Subclass 820) lets the spouse or partner of an Australian permanent resident, Australian citizen, or eligible New Zealand citizen to live in Australia temporarily. Getting this visa is also the first step toward a Permanent Partner Visa (Subclass 801).

It offers a temporary stay in Australia until the Permanent Partner Visa is processed. In most cases, the stay is for 15 to 20 months. You are allowed to study, travel, and even work in Australia during your stay.

ELIGIBILITY

To be eligible, you need to fulfil the following criteria:

  • You should be in a genuine relationship with an Australian permanent resident, Australian citizen, or eligible New Zealand citizen as your spouse or de facto partner
  • When applying for a visa, you should be present in Australia and when they make their decision on your temporary visa application. The family members who apply with you must also be Australian citizens.

DOCUMENTS

While applying for this visa, you must provide some documents like:

  • Identity documents, including birth certificates and passports, show everything in detail.
  • Proof of your relationship with your partner. It may be a marriage certificate or proof of your de facto relationship.
  • A character certificate for Australian police.
  • Details about dependents.

PROCESS

When applying, you and any family member or dependent child applying with you must be in Australia. But none should be in immigration clearance. Complete your application in ImmiAccount and pay the required fee to process your application.

In most cases, the stay through Partner Visa Temporary (Subclass 820) is for no more than 15-24 months. But mostly, a Permanent Visa is granted by that time.

Fees
Prospective Marriage Visa (Subclass 300) holders for the main applicant is AUD 1,310. If you previously have had a Prospective Marriage Visa, however, still did not apply for the subclass 820 and 801 visas before the expiration of that visa, then the fee would be AUD 1,660.

  • Dependent Child Visa (subclass 445) holders: Nil.
  • Most other applicants: AUD 7,850 for the main applicant.

The cost covers this Temporary Visa and the Permanent Partner Visa (Subclass 801). Note that every family member applying with you also has to pay a fee.

EXTENSION

The visa can be further extended to a Permanent Partner Visa (Subclass 801), allowing you to stay indefinitely in the country.
