About

If you have been living in the UK legally for a period of 10 years (known as a 'long residence),' so you can apply for Indefinite Leave To Remain (ILR). You settle in the UK by obtaining indefinite leave to remain. It is also known as settlement. Thus you can live, study and work as long as you wish. Also, you can apply for benefits if you are eligible. Further, you may use it for applying for citizenship. 

How long does Indefinite Leave To Remain last?

Indefinite Leave to Remain has no time limit. However, it is important to remember that do not spend more than two years outside the UK. It is because it may result in the loss of ILR.

Eligibility

If you have any one of the following mentioned visas, you may settle permanently in the UK: 

  • Skilled Worker or Tier 2 (General) 
  • Skilled Worker or Tier 2 (General), T2 Minister of Religion or Tier 2 (Minister of Religion) 
  • International Sportsman, Tier 2 Sportsman or T2 Sportsman
  • Global Talent
  • Tier 1 (Investor)
  • Tier 1 (Entrepreneur)
  • A partner - with your family visa
  • A partner - as a dependent on your partner’s work visa
  • A parent - with your family visa
  • A child - with your family visa
  • A child - as a dependant on your parent’s work visa
  • An adult-dependent relative on a family visa

You can also be eligible under certain conditions:

  • You are a refugee. Or have humanitarian protection or a discretionary Leave
  • After serving in the armed forces.
  • Returning back to the UK after previously having been granted indefinite leave to remain.

Documents

The documents required are:

  • Accommodation information and evidence.
  • Evidence of your English language proficiency.
  • Passport
  • Biometric residence permit
  • Financial documents

It is not essential to provide documents in original form. However, you will be informed if that is the case. The only passport needs to be original. The documents you provide must be in either English or Welsh. If they are not in these languages, then you must provide translations.

Process

Your application should include:

  • 2 passport-sized photos 
  • Any valid passports as well as any expired passports 
  • An application form which is signed
  • Fee for application 
  • All those supporting documents on which you need to rely to support the application.

When to Apply
Apply within three months of issuing your visa.

ILR doesn't have a fixed duration as it is definite. But if there is an absence of 2 or more years from the UK, it could expire.

The Indefinite Leave to Remain application fee is £2,389.

You can live as long as you desire so there is no need for extension, it is indefinite.
